Canberra man in love with teen avoids jail for underage sex - Yahoo!7 News


The ACT Supreme Court has heard a case involving underage teenage sex is unusual because of the couple's genuine affection for each other.


From late 2010, a 17-year-old boy had sex a number of times with a 13-year-old girl, who became pregnant and had a miscarriage.


When she went to the Canberra Hospital, staff alerted child authorities.


The man, now 20, has pleaded guilty to having sex with a girl aged under 16, an offence that attracts up to 14 years in jail.


The pair is now engaged.


The crown accepted it was an unusual case because the offence reflected genuine affection on both sides, but cautioned even willing victims are entitled to the law's protection.


During sentencing Justice John Burns said the matter was serious but noted the man's early admission of guilt, history of mental illness and excellent prospects of rehabilitation.


The man received an 18-month good behaviour order and no conviction was recorded.
