Legal fight over Black Mountain Tower condition - ABC Online

Telstra is defending its maintenance of Canberra's iconic Black Mountain Tower, in response to claims about unsafe and faulty equipment.


A Canberra businessman concerns about faulty equipment at the city's iconic Black Mountain Tower will be heard in court.


Mickey Gubas, who has run the tower's restaurant and cafe since 2006, has not paid rent to Telstra for two years.


He says equipment including the elevator often breaks down and it is costly for his business.


"Basically none of the services have been upgraded, basic services like the lift, the air conditioning, the drainage, they've all sort of been patched," he said.


"We've had at least five occasions where our staff have got stuck in the lift.


"The visitor numbers have dropped by half since we've been there."


He says he paid for a 2011 building inspection report, which highlighted those problems.


The dispute between Mr Gubas and Telstra is before the ACT Supreme Court.


Telstra is seeking two years of unpaid rent from Mr Gubas and says it has taken its own legal action as a last resort.


A spokesman says Black Mountain Tower is well maintained, repairs are promptly made and all amenities are safe and in working order.
